Standard terms & conditions of contract for the supply of permanent senior carers from Eastern Europe and Bulgaria
1. These terms and conditions of business are between "Concordia Group" Ltd (hereinafter called the company) and the employer client (hereinafter called the client) and are deemed to be accepted by the client by virtue of the engagement (which term includes employment or use, whether under a contract of service or for services, or under an agency, licensee, franchise or partnership agreement) of an applicant introduced by the company.
2. The supply of staff is solely within England, Scotland and Wales.
3. The client agrees:
[a] to notify the company immediately an engagement is accepted.
[b] to pay the fee of the company within fourteen days of the commencement of the engagement.
4. The fee payable to the company by the client for the introduction of the applicant is £200. Vat will be charged in addition to the fee. If the fee is not met in total within 14 days of the commencement of employment, the company reserves the right to withdraw the employee from the employment of the client.
5. The company makes every effort to deliver each applicant upon the stated date. However the company cannot be held responsible when travel arrangements cause a delay in their arrival but the company will make every effort to advise any delay as soon as possible.
6. Should the relevant employment terminate before the expiry of 26 weeks, the company will replace that person, free of charge within a reasonable time, provided that the client notifies the company in writing within 7 days of the termination of employment, and has paid the company’s fee within the 14 days of the date of the invoice. Should the client or any subsidiary or associated company of the client subsequently re-engage the applicant within the period of 12 calendar months from the date of termination a full fee in accordance with paragraph 3 becomes payable.
7. Introductions are confidential. The passing on of an introduction to another employer which results in an engagement renders the client liable to payment of the company’s fee as set out in paragraph 3.
8. An introduction fee calculated in accordance with paragraph 3 of these terms will be charged in relation to any applicant engaged as a consequence of or resulting from an introduction by or through the company, even though the introduction may be made indirectly.
9. The company endeavours to ensure the suitability of any applicant introduced to the client. The client shall notwithstanding satisfy himself as to the suitability of any applicant and shall take up any references provided by any applicant and/or the company before engaging such applicant. The company shall be responsible for obtaining work and other permits. The client shall be responsible for the arrangement of any additional medical examinations and/or investigations into the medical history of any applicant, and satisfy any medical requirements or qualifications required by law.
10. The company shall not be liable under any circumstances for any loss, damage or expense suffered or incurred by the client arising from or in any way connected with the company seeking an applicant for that client or the introduction by the company to the client of any applicant or the engagement of any applicant by the client.
11. These terms constitute the terms and conditions of business between the company and the client and no variation of these terms and conditions shall be accepted without the written consent of a director of the company.
12. The company contract to identify and supply permanent (the normal minimum contract period will be for not less than 24 months) senior carers for the client within England, Scotland and Wales. It is the nature of this arrangement that each applicant will be sourced overseas and that the company undertake to provide the necessary UK visa and work permit to allow lawful entry into the UK.
13. The client must provide a satisfactory written and signed client agreement/job order before any potential staff are approached by the company and this must be accompanied by the required documentation, as follows (which may be varied from time to time).
